These Terms govern your use of EdCommit. Please read them carefully. By using the platform, you agree to these terms.

1. Acceptance of Terms

By accessing or using EdCommit ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not access or use the Platform. We reserve the right to modify these terms at any time, with notice provided via email or the Platform.

2. Eligibility

You must be at least 13 years of age to use EdCommit. By using the Platform, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement. If you are under 18, you must have parental or guardian consent.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary. You must notify us immediately at support@edcommit.com if you suspect unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Student Terms

4.1 Course Enrolment

Upon purchasing or freely enrolling in a course, you receive a limited, non-exclusive, non-transferable licence to access and view the course content for personal, non-commercial, educational purposes. Courses are for your individual use only and may not be shared, redistributed, or resold.

4.2 Refund Policy

You may request a refund within 30 days of purchase for any paid course, provided you have completed less than 30% of the course content. Refund requests can be submitted through your account settings or by emailing support@edcommit.com. Refunds will be processed to the original payment method within 5-10 business days.

4.3 Community Memberships

Community membership subscriptions are billed on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused subscription periods.

4.4 Certificates

Certificates issued upon course completion are for personal use and serve as proof of participation on the EdCommit platform. They do not confer academic credit unless explicitly stated by the course or institution.

5. Educator Terms

5.1 Content Ownership

You retain ownership of all course content and community content you create. By publishing content on EdCommit, you grant us a worldwide, non-exclusive, royalty-free licence to host, display, and distribute your content solely for the purpose of operating the Platform.

5.2 Content Standards

Your content must be accurate, original, and comply with all applicable laws. You must not publish misleading, harmful, adult, or plagiarised content. We reserve the right to remove content that violates our content standards without notice.

5.3 Revenue Share

Educators receive a share of revenue from course sales and community subscriptions. The revenue split is defined in your Educator Agreement. EdCommit retains a platform fee on all transactions to cover infrastructure, payment processing, and support costs.

5.4 Payout Terms

Payouts are processed via Stripe Connect. You are responsible for providing accurate payment information and complying with all applicable tax obligations in your jurisdiction. EdCommit does not provide tax advice.

5.5 Educator Verification

Educator accounts may be subject to verification by our admin team. We reserve the right to approve, reject, or revoke educator status at our sole discretion.

6. Prohibited Conduct

You agree not to: (a) use the Platform for any unlawful purpose; (b) post offensive, discriminatory, or harmful content; (c) attempt to gain unauthorised access to any part of the Platform; (d) scrape, crawl, or extract data from the Platform without permission; (e) impersonate any person or entity; (f) distribute spam, malware, or phishing content; (g) harass, bully, or threaten other users; (h) attempt to circumvent payment systems; or (i) engage in any conduct that disrupts the Platform's operation. Violations may result in immediate account suspension or termination.

7. Intellectual Property

The EdCommit platform, including its design, code, branding, trademarks, and EdCommit-created content, is owned by EdCommit and protected by intellectual property laws. You may not copy, reproduce, modify, or create derivative works of EdCommit's proprietary content without express written permission.

8. Privacy

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using EdCommit, you consent to our data practices as described in the Privacy Policy.

9. Third-Party Services

The Platform integrates with third-party services including Stripe, Razorpay, Supabase, OpenAI, and Google. These services have their own terms and privacy policies. EdCommit is not responsible for the content, policies, or practices of third-party services.

10. Disclaimers & Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, EDCOMMIT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless EdCommit, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

12. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your account with or without notice for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform immediately ceases. Provisions of these Terms that by their nature should survive termination shall survive.

13. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of India. We encourage you to contact us first at support@edcommit.com to resolve disputes informally before initiating any legal proceedings.

14. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes by email or through the Platform. Your continued use of EdCommit after the effective date of updated Terms constitutes your acceptance.
